These Terms are a contract between you and Formwork Security, LLC ("we" or "us"). They cover Call Screener and its related websites and apps (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service does
Call Screener answers calls that your phone forwards to it. It asks the caller who they are and why they are calling. Based on your settings, it then connects the call to you, takes a message, or ends the call. The Service uses automated systems, including artificial intelligence, to do this.
2. What the Service is not
- Not an emergency service. Do not rely on the Service for calls to or from 911, emergency responders, or any call where a delay or a missed call could cause harm.
- Not a phone company. Your carrier provides your phone service. The Service depends on your carrier's call forwarding, which we do not control.
- Not a guarantee. The Service may end, delay, misroute, or fail to connect legitimate calls. It may also connect unwanted calls. Automated decisions can be wrong. You are responsible for checking your call log and messages and for returning any call you need to return.
3. Who can use it
- You must be at least 18 years old and use a United States phone number.
- You must be the account holder or an authorized user of every phone line you connect.
4. Your responsibilities
- Call forwarding. You turn call forwarding on and off with your carrier. If you cancel, you must turn forwarding off. Calls forwarded after you cancel may go unanswered.
- Authorization. You authorize us to answer forwarded calls on your behalf, to speak with callers through an automated assistant, to transcribe those calls, and to record and transcribe voicemails callers leave. You also authorize us to keep the resulting call records and use them to provide and improve the Service, including by training AI models, as the Privacy Policy describes. We record voicemails and take messages only to deliver them to you, and we do not use them to train AI models or improve the Service. Our service providers may retain call data under their own terms.
- Carrier charges. Any charges from your carrier for forwarding, minutes, or data are yours.
- Your account. Give us accurate information and keep your login secure. Tell us promptly if you think someone else has used your account.
- Lawful use. Use the Service only as the law allows.
5. Fees and fair use
- No charge. The Service is currently free. If we introduce paid features, we will tell you the price and terms first, and we will not charge you unless you agree to them.
- Fair use. The Service is for personal use, one person per line. We may limit or suspend a line whose usage is unusually high or places an unreasonable load on the Service.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, harassing, or deceptive;
- use the Service to run a call center or shared business line;
- resell the Service or give others access to your account;
- interfere with the Service, probe it for weaknesses, or reverse engineer it; or
- use the Service to record calls for any purpose other than screening them.
7. Ending the Service
You can stop using the Service at any time. We may suspend or end your access if you break these Terms, or if we stop offering the Service. Sections 8 through 13 continue to apply after the Service ends.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BLOCK ANY PARTICULAR CALL, CONNECT ANY PARTICULAR CALL, IDENTIFY ANY CALLER CORRECTLY, OR OPERATE WITHOUT INTERRUPTION OR ERROR.
Some states do not allow certain disclaimers, so parts of this section may not apply to you.
9. Limit of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR LOSSES FROM MISSED, BLOCKED, DELAYED, OR WRONGLY CONNECTED CALLS.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100.
These limits apply to every legal theory and even if a remedy fails of its essential purpose. They do not limit liability that the law does not allow us to limit.
10. Indemnity
You will defend us and pay any resulting costs if a third party brings a claim against us that arises from your breach of these Terms, your misuse of the Service, or your connecting a phone line you were not authorized to connect.
11. Disputes
- Talk to us first. Before filing any claim, email legal@formworksecurity.com with your name, account phone number, and a description of the dispute. We will each try in good faith to resolve it within 30 days.
- Time limit. To the extent the law allows, any claim must be filed within one year after it arises.
- Governing law and courts. Illinois law governs these Terms, without regard to its conflict-of-law rules. Any claim will be heard in the state or federal courts in Cook County, Illinois, and you and we consent to their jurisdiction. Either of us may also bring an individual claim in small claims court where it qualifies.
12. Changes to these Terms
We may update these Terms. We will post the new version here, and the date at the top shows the latest version. Using the Service after an update means you accept it. If you do not agree, stop using the Service.
13. General
- License. We grant you a personal, non-exclusive, non-transferable license to use the Service under these Terms. We own the Service and all rights in it.
- Feedback. We may use any suggestions you send us without owing you anything.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If a court finds any part of these Terms unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a term, we have not given it up.
- Assignment. You may not transfer these Terms. We may transfer them as part of a merger, sale, or reorganization.
